INFORMATION PURSUANT TO ARTICLES 13-14, GDPR UE/2016/679

The European Regulation EU/2016/679 (hereinafter "Regulation") establishes rules on the protection of individuals with regard to the processing of personal data, as well as rules on the free movement of such data. In compliance with the principle of transparency provided for by Article 5 of the Regulation, SPHERA SRL Via Boggia, 45 Gattico-Veruno (NO), as Data Controller, provides you with the information required by Articles 13 and 14 of the Regulation.

PURPOSE OF PROCESSING 

The processing of your personal data will be based on the principles of correctness, lawfulness and transparency, protecting your confidentiality, your rights and in compliance with the company's privacy policy. The company also undertakes to process your data in compliance with the principle of "minimisation", i.e. acquiring and processing the data only to the extent necessary for the following purposes:

  • Management of contracts/pre-contracts
  • Web navigation
  • Trade relations management (including accounting, invoicing and debt collection)
  • Information on new products and/or services by e-mail
  • Handling of user requests of a commercial, technical and/or catalogue nature

However, the provision of your personal data and consent to its processing for the above-mentioned purposes is obligatory (with the exception of sending promotional emails which is optional) and your refusal prevents the correct stipulation and subsequent execution of the contract.

MODALITIES OF TREATMENT

The processing of your personal data will be carried out by means of paper and IT tools in compliance with the provisions on the protection of personal data and, in particular, with the appropriate technical and organisational measures referred to in Article 32.1 of the Regulation, and with the observance of all precautionary measures to ensure the integrity, confidentiality and availability of such data.

CATEGORIES OF RECIPIENTS

Your personal data may be communicated, strictly in relation to the above-mentioned purposes, to the following subjects or categories of subjects:

a) Consultants, freelancers and Multi-mandate agents

In relation to these categories of recipients, the Data Controller undertakes to rely exclusively on entities that provide adequate data protection guarantees, and will appoint them as Data Processors of the Processing pursuant to Article 28 of the Regulation. The list of Data Processors is available in the company and may be viewed upon request to the Data Controller. Your data will also be processed, exclusively for the above-mentioned purposes, by company employees and/or collaborators, specifically authorised and instructed by the Data Controller pursuant to Art. 29 of the Regulation. Your personal data will not be disclosed, unless required by a law or regulation or by EU legislation.

TRANSFER OF PERSONAL DATA

Your personal data will not be transferred to non-European countries or to international organisations.

STORAGE PERIOD

The storage period for your personal data is 24 months. The following categories of data fall under retention:

  • Personal data (name, surname, sex, place and date of birth, residence, domicile)
  • Browsing data (IP address, computer domain name, time and method of request to the server, etc.)
  • Contact data (telephone number, e-mail, etc.)

RIGHTS GRANTED TO THE DATA SUBJECR

You may at any time exercise your rights under Articles 15-22 of the Regulation vis-à-vis the Controller. In particular, at any time, you shall have the right to request:

  • access to your personal data;
  • their rectification in the event of their inaccuracy;
  • cancellation;
  • the restriction of their processing.

It will also have:

  • the right to object to their processing if they are processed in pursuit of a legitimate interest of the Data Controller, if they consider their fundamental rights and freedoms to have been violated;
  • the right to withdraw your consent at any time in relation to the purposes for which it is needed;
  • the right to the portability of your data, i.e. the right to request and receive in a structured, commonly used and machine-readable format, personal data relating to you.
